Illinois Dooring Rules & Fault

Illinois law prohibits opening a vehicle door into moving traffic until doing so is reasonably safe and won’t interfere with traffic. A driver or passenger who opens a door across a cyclist’s path may bear responsibility, but liability isn’t automatic. It depends on the positions of the vehicle and bicycle, what each person could see, and other evidence from the collision.

Cyclists generally have the same rights and responsibilities as motorists under Illinois law. Motorists passing a bicycle must generally leave at least three feet of clearance. That requirement and the vehicle door safety rule may both be relevant when reconstructing events near parked or stopped vehicles.

Fault may also be divided among the people involved. Under Illinois modified comparative negligence rules, an injured cyclist’s compensation is reduced by that person’s percentage of responsibility. Recovery is barred if the cyclist is found more than 50% at fault.

Compensation, Insurance & Illinois Filing Deadlines

Responsibility still depends on the complete facts rather than the sticker alone.
